South Elgin man charged with public indecency at Charlestowne Mall

ST. CHARLES – A 70-year-old South Elgin man was charged with misdemeanors last week after sexually gratifying himself at Charlestowne Mall, St. Charles police said.

Police responded to Classic Cinemas Charlestowne 18, 3740 E. Main St., St. Charles, about 1:11 p.m. Aug. 16 for a report of public indecency.

Kenneth Ray Rutherford, of the 200 block of West Quarry Street, South Elgin, was reportedly along the railing in the upper level of the mall, looking down at the theater's box office.

He had his back to the approaching officer, but it appeared he was masturbating, police said.

Rutherford, who was charged with indecent exposure and disorderly conduct, was taken to the St. Charles Police Department. He was booked, processed and released on a cash bond, police said. He is expected in court Oct. 3.
