Batavia aldermen recommend moratorium on non-retail uses
BATAVIA – Batavia aldermen are considering a temporary ban on nonretail uses along Randall Road and other commercial districts.
Aldermen at Tuesday’s Joint Committee of the Whole meeting recommended a six-month moratorium on accepting applications for certain non-retail uses in commercial districts such as Randall and Kirk roads. Those uses would include banks and health care facilities.
While the moratorium is in place, staff would work with the City Council’s Community Development Committee to see what ordinance changes may be necessary to address the concerns about non-retail uses in commercial districts.
The recommendation will go to the full City Council. As proposed, any uses listed as a conditional use in an annexation agreement or a planned development would also be subject to the moratorium.
Batavia Mayor Jeff Schielke recently voiced concerns about nonsales-tax generating businesses trying to locate on Randall Road. He had voiced the need for the city to “put some constraints on how much nonsales-tax use we put on Randall Road.”
Earlier this month, aldermen approved amending a city ordinance to allow medical offices as a conditional use. Pacer Dental proposes to open a full-service dental practice in a 1,525-square-foot building at 853 N. Randall Road, located near the Walmart store at the southwest corner of Randall Road and Fabyan Parkway.
Originally, medical and dental clinics were listed as prohibited uses.
In 2009 – at the request of the property owner, Aetna Development Corp. – the Batavia City Council approved an ordinance that removed medical and dental clinics from the list of prohibited uses, but no action was taken to add them to the list of allowed uses.
Schielke said he wasn’t concerned about Pacer Dental’s proposal because of its small size.
But he was worried about larger, nonsales-tax generating businesses trying to locate on Randall Road.
