South Elgin man guilty of public indecency in Charlestowne Mall incident

ST. CHARLES – A South Elgin man accused last year of sexually gratifying himself at Charlestowne Mall has pleaded guilty to public indecency, according to Kane County court records.

Kenneth Ray Rutherford, 71, entered the plea on Jan. 16. It was accepted by Judge Elizabeth Flood.

He was sentenced to supervision and is expected in court on July 17, according to records.

Records indicate that a related charge of disorderly conduct was dismissed.

St. Charles police charged Rutherford with the two misdemeanors last August after he was seen masturbating in the upper level of Charlestowne Mall near Classic Cinemas Charlestowne 18.
