News Story of the Year: 'What's Happening' faces lawsuit

Patriot Heating and Cooling Services Inc. filed a lawsuit against Kevin Ketchum, an agent or partner of Geneva-based Nexxus Publishing, alleging that the "What's Happening" Facebook pages were engaging in deceptive advertising.

McNally's Heating and Cooling Inc. in St. Charles, Nexxus Publishing and Alan Herra of Jackson Alan Services in Elburn are also defendants in the ongoing case.

The case stems from a June 1 "What's Happening" post that was critical and disparaging of Patriot's business.

The lawsuit seeks more than $250,000 in compensation, punitive damages and legal fees. Attorneys for Ketchum, Nexxus and McNally said that the statements published by Nexxus did not constitute a violation of the Illinois Deceptive Trade Practices Act. The motion to dismiss also stated that Patriot didn't list any facts to support the claim that its business was damaged.

The next court date is Jan. 17, according to court documents.
