Geneva aldermen approve settlement for injured worker

Agreement includes resignation/retirement for electric lineman

GENEVA – Geneva aldermen unanimously approved a $57,500 “full and final” workers compensation claim for an electric department employee, as well as a general release and voluntary resignation/retirement agreement.

After a brief closed session Aug. 5, aldermen approved the settlement with David L. Rowland Jr., a former electric lineman.

According to documents released after a Freedom of Information Act request, Rowland injured his left shoulder pulling wire and opening transformers on Jan. 5, 2018 and could not return to work for 14 weeks, documents show.

Rowland was temporarily totally disabled from June 5 through through Aug. 19, 2018 and from Dec. 10 through Dec. 21, 2018 and from Jan. 2 through Jan.13, 2019, documents show.

The settlement represents an approximate “14.5% loss of use man as a whole,” regarding Rowland's injured shoulder, documents show.

The four-page general release and voluntary resignation/retirement document, dated Aug. 7, also releases the city from any and all claims and waives Rowland’s right to be re-employed by the city.

The settlement agreement also states that, “Employee also agrees not to disclose to anyone the terms and conditions of this settlement and release agreement. Breach of this clause shall subject the employee to a breach of contract suit and liability for damages not to exceed $10,000, plus attorney’s fees and costs.”
